Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Tactic Build platform, websites, and related services (collectively, the “Service”), operated by Tactic Build (“Tactic Build,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Agreement to Terms

By accessing or using the Service, you confirm that you can form a binding contract with Tactic Build and that you accept these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization.

2. The Service

Tactic Build is a multi-tenant compliance platform that helps construction and contracting teams organize projects, map work against construction design-standard reference material, track pass/fail compliance checklists, invite team members, and export inspection logs. Features may change, be added, or be removed over time.

3. Accounts and Eligibility

You must provide accurate, current information when registering and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You must be at least 18 years old to use the Service.

4. Organizations, Roles, and Team Members

Each account belongs to an organization (a “tenant”), and organization data is isolated from other tenants. Organization administrators may invite members and assign roles (such as Contractor or Inspector). The organization and its administrators are responsible for managing member access and for their members’ use of the Service.

5. Subscriptions, Billing, and Cancellation

Paid plans are billed through our third-party payment processor, Stripe. Subscription fees recur on the interval you select (monthly or annually) and automatically renew until cancelled. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis.

You may cancel or change your plan at any time through your billing control panel. Cancellation takes effect at the end of the current billing period, and you will retain access until then. Except where required by law, fees already paid are non-refundable and we do not provide prorated refunds for partial periods. We may change pricing with reasonable advance notice, effective on your next renewal.

6. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • attempt to access data belonging to another organization, or probe, scan, or circumvent security or tenant-isolation controls;
  • reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
  • upload malicious code or interfere with the integrity or performance of the Service;
  • misrepresent your compliance status to any third party based on output from the Service (see Section 7).

7. Compliance Content — No Professional Advice

The design standards, code references, checklists, and related content made available through the Service are provided for informational and organizational purposes only. They are not legal, engineering, architectural, or other professional advice, and they do not guarantee compliance with any code, regulation, standard, or the requirements of any Authority Having Jurisdiction.

You are solely responsible for independently verifying all requirements against official, authoritative sources and for actual compliance on your projects. Any reliance on content from the Service is at your own risk.

8. Your Data

You retain ownership of the data and content you submit to the Service (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to operate and provide the Service to you. You are responsible for the accuracy, quality, and legality of Customer Data and for having the rights necessary to submit it.

9. Intellectual Property

The Service, including its software, design, and the Tactic Build name and logos, is owned by Tactic Build and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service. We reserve all rights not expressly granted.

10. Third-Party Services

The Service relies on third-party providers, including Stripe for payment processing and email and hosting providers for delivery and infrastructure. Your use of those services may be subject to their own terms, and we are not responsible for third-party services or their availability.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Tactic Build will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold Tactic Build harmless from any claims, damages, liabilities, and expenses arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. Upon termination, your right to use the Service ceases; provisions that by their nature should survive (including Sections 7, 9, 11, 12, and 13) will survive.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms with a new “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. The exclusive venue for any dispute will be the state or federal courts located in Washington, unless otherwise required by applicable law.
